Warrant for Town Meeting
Saturday, March 20, 1999

TO: Louise H. Lester, a resident of the Town of Raymond, in the County of Cumberland and State of Maine.

GREETINGS:

In the name of the State of Maine, you are hereby required to notify and warn the inhabitants of the Town of Raymond, qualified by law to vote in Town affairs, to meet at the Jordan Small School, in said Town of Raymond on Saturday, March 20, 1999, at 10:00 AM, then and there to act on the following articles:

Article 1: To elect a moderator to preside at said meeting.

Article 2: To see if the Town will vote to authorize the Selectmen on behalf of the Town to sell and dispose of any property acquired by the Town for nonpayment of taxes pursuant to the policy adopted by the Selectmen, as may be amended from time to time, the policy to remain consistent with State statutes and laws. In all cases conveyance to be made by municipal quit claim deed.

The Selectmen recommend adoption of this article.

Article 3: To see what date taxes will be due and to set an interest rate for unpaid amounts.

The Selectmen recommend 1st half to be due October 31, 1999 and 2nd half to be due April 30, 2000 with interest at ten (10.00%) on any unpaid balances.

The Selectmen recommend adoption of this article.

Article 4: To see if the Town will vote to set the interest rate to be paid by the town on abated taxes at eight (8.00%) per cent for the fiscal year.

The Selectmen recommend adoption of this article.

Article 5: To see if the Town will vote to authorize the Board of Selectmen to dispose of Town owned personal property and to set a maximum value of $35,000 for each item and for such authority with authority to be in effect March 21, 1999.

Selectmen and Budget Committee recommend adoption of this article.

Article 6: To see what sum the Town will vote to authorize the Selectmen to borrow from or appropriate from undesignated surplus as they deem advisable to meet the unanticipated needs of the community that occur during the fiscal year.

Selectmen and Budget Committee recommend up to $50,000.

Article 7: To see if the Town will authorize the Selectmen, for the fiscal year 1999 – 2000, to transfer funds between appropriation accounts as long as the grand total of all appropriations is not exceeded. Any such transfers to be approved only at a properly called public meeting of the Selectmen.

Selectmen and Budget Committee recommend adoption of this article.

Article 8: To see if the Town will vote to authorize the use of Town employees and/or Town owned equipment for maintenance on private roads in special and certain circumstances.

Note of explanation -- Three examples of when the use of Town employees and equipment is necessary include the following:

A. Tying in work done on a public road that intersects a private road;

B. Plowing snow on a private road to clear the way for emergency response apparatus; and

C. In rare or emergency situations, maintaining private roads for school bus access to special education students as deemed necessary.

The Selectmen recommend adoption of this article.

Article 9: To see if the Town will vote to authorize the Tax Collector or Treasurer to accept prepayments of taxes not yet committed pursuant to 36 M.R.S.A. ss. 506.

The Selectmen recommend adoption of this article.

Article 10: To see if the Town will vote to authorize the Selectmen to amend the current municipal recycling curbside pickup contract with Pine Tree Waste, Inc. Such contract will obligate the Town to extend the contract through March 31, 2001. (A copy of the proposed contract amendment is available at the Office of the Town Clerk and is attached to the official Town Meeting Warrant as Appendix A.)

The Selectmen recommend adoption of this article.

The Budget Committee recommends adoption of this article.

Article 11: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Change Article IV, F,4,a. (COMMERCIAL ZONE) page 16:

The minimum lot area shall be 20,000 square feet.

The Planning Board recommends adoption of this article.

Article 12: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Add the following to Article X,b,1 (SITE PLAN REVIEW) page 52:

The authority of the Planning Board to review certain minor development projects as defined in this Section is hereby delegated to the Code Enforcement Officer.

Minor Development: For new buildings or additions to existing buildings that do not exceed 2,000 square feet of gross floor area in any 12 month period or additional pavement of not over 2,000 square feet in any 12 month period; the Code Enforcement Officer may issue the permit, provided that the application is in compliance with all relevant provisions of this ordinance.

Minor Modifications: The Code Enforcement Officer may deem proposed changes to a site plan or related materials as a minor modification when the building or pavement does not exceed 2,000 square feet in any 12 month period in which case site plan approval by the Planning Board shall not be necessary.

The Code Enforcement Officer’s review and approval is based upon the application plans and materials submitted by the applicant. Any unresolved issues between the Code Enforcement Officer and the applicant shall be settled by a full site plan review by the Planning Board.

The Planning Board recommends adoption of this article.

Article 13: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Change Article X,D,1,6 (Site Plan Review) page 56 to read:

"contours at no more than two (2) foot intervals".

The Planning Board recommends adoption of this article.

Article 14: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Change Article X,D,1,24 (Site Plan Review) PAGE 57:

Reword this section to read as follows:

"A notarized statement by the developer explaining how the developer intends to comply with the performance guarantee requirement of Article X,C,3,a."

The Planning Board recommends adoption of this article.

Article 15: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Change Article X,f,1,d. of the Land Use Ordinance by adding:

"rear or side yards" after front yard.

The Planning Board recommends adoption of this article.

Article 16: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended as follows:

Change Article IX,R.(Minimum Standards) page 50, to read:

"A new driveway in any zone shall be constructed and maintained to prevent water or runoff from reaching the paved or traveled portion of the street. This standard shall not be subject to a waiver by the Planning Board or a variance by the Board of Appeals."

The Planning Board recommends adoption of this article.

Article 17: Shall an ordinance entitled Land Use Ordinance of the Town of Raymond, Maine be amended to add a section, Section S, entitled Wireless Communications Facilities to Article IX, Minimum Standards. (A copy of the proposed addition to the Land Use Ordinance is available at the Office of the Town Clerk and is attached to the official Town Meeting Warrant as Appendix B.)

The Planning Board recommends adoption of this article.

Article 18: Shall an ordinance entitled Town of Raymond Cemetery Ordinance be adopted. (A copy of the proposed ordinance is available at the Office of the Town Clerk and is attached to the official Town Meeting Warrant as Appendix C.)

Article 19: To see if the Town will vote to authorize the Selectmen to enter into a five year contract with the Lewiston - Auburn Water Pollution Control Authority, such contract to provide Raymond with a place to take its septic tank waste and to close the existing site located near the end of Patricia Avenue. (A copy of the proposed contract is available at the Office of the Town Clerk and is attached to the official Town Meeting Warrant as Appendix D.)

The Selectmen recommend adoption of this article.

The Budget Committee did not have an opportunity to make a recommendation before the official Town Meeting Warrant was posted. A Budget Committee recommendation will be announced at Town Meeting.

Note: If Article 19 is adopted the anticipated total Raymond citizen cost of disposal will be $0.19/gallon including a $0.08/gallon fee to the pumper-hauler service for pumping and delivery; and a $0.11/gallon fee to the Lewiston-Auburn Water Pollution Control Authority for treatment services.

Article 19A: Shall the Town appropriate a sum not to exceed $93,000 to fund the costs of a public improvement project consisting of renovation and expansion of the septic spreading facility; and to fund said appropriation (a) to see what sum the Town will vote to raise and appropriate; or (b) to see what sum the Town will vote to appropriate from surplus; or (c) to see what sum the Town will authorize the Treasurer and Chairman of the Board of Selectmen to borrow and to authorize the Treasurer and Chairman of the Board of Selectmen to issue general obligation securities of the Town of Raymond, Maine (including temporary notes in anticipation of the sale thereof) in an aggregate principal amount not to exceed $93,000 and the discretion to fix the date(s), maturity(ies), interest rate(s), call(s) for redemption, place(s) of payment, form, and other details of said securities, including execution and delivery of said securities on behalf of the Town of Raymond, and to provide for the sale thereof, is hereby delegated to the Treasurer and Chairman of the Board of Selectmen.

EXPLANATION AND RECOMMENDATIONS:

This article is written so that the voters can choose how to fund this project if they choose to proceed with the project.

Selectmen recommend no appropriation.

The Budget Committee did not have an opportunity to make a recommendation before the official Town Meeting Warrant was posted. A Budget Committee recommendation will be announced at Town Meeting.

Note: If Article 19A is adopted the anticipated total Raymond citizen cost of disposal will be $0.14/gallon including a $0.08/gallon fee to the Town of Raymond and $0.06/gallon fee to the pumper-hauler service for pumping and delivery.

FINANCIAL STATEMENT

Total Indebtedness

Costs

At an estimated maximum interest rate of 7 % for a one (1) year maturity, the estimated costs of this bond issue will be:

Principal: $ 93,000

Interest: $ 6,510

Total Debt Service: $ 99,510

 

Validity: The validity of the bonds and of the voters’ ratification of the bonds may not be affected by any errors in the above estimates. If the actual amount of the total debt service for the bond issue varies from the estimate, the ratification by the electors is nevertheless conclusive and the validity of the bond issue is not affected by reason of the variance.

Town Treasurer

Article 19B: To see what amount the Town will authorize the Selectmen to charge as user fees for services related to the disposal of septic tank waste.

Selectmen recommend a fee of $0.08/gallon of waste disposed if Article 19 is defeated.

The Budget Committee did not have an opportunity to make a recommendation before the official Town Meeting Warrant was posted. A Budget Committee recommendation will be announced at Town Meeting.

Article 20: To see if the Town will vote to authorize the Selectmen to grant Charles Leavitt, for consideration of $2,000, a perpetual transferable easement on land owned by the Town adjacent to the former Grange property; for a septic system, and a perpetual nontransferable easement for 25 parking spaces, interior access roads, any necessary appurtenances; with the exact size and location acceptable to the Selectmen; with the provision that the Town may require Charles Leavitt to relocate the facilities at any time to another location with the reasonable costs of the relocation borne by the Town?

Selectmen recommend adoption of this article.

The Budget Committee did not have an opportunity to make a recommendation before the official Town Meeting Warrant was posted. A Budget Committee recommendation will be announced by Town Meeting.

Article 21: Shall the Town of Raymond, Maine ["Town"] vote to amend the Municipal Development and Tax Increment Financing District and the Development Program for the District (Attached to the original Town Meeting Warrant as Appendix E with copies available in the office of the Town Clerk.), which was originally approved at a duly called Town Meeting on September 15, 1998, in accordance with the following terms and conditions.

WHEREAS, the Town is authorized pursuant to Chapter 207 of Title 30-A of the Maine Revised Statutes, as amended, to designate a specified area within the Town as a Municipal Development and Tax Increment Financing District [the "District"] and to adopt a Development Program for such District; and

WHEREAS, there is a need for economic and community development in the Town and to provide continuing employment opportunities for the citizens of the Town and the surrounding region; to improve and broaden the tax base of the Town and to improve the general economy of the Town, the surrounding region and the State of Maine through the establishment of a Municipal Development and Tax Increment Financing District in accordance with the provisions of Chapter 207 of Title 30-A; and

WHEREAS, the Town has held a Public Hearing on the questions of establishing the District in accordance with the requirements of Chapter 207, 30-A M.R.S.A. upon at least ten [10] days prior notice published in a newspaper of general circulation in the Town.

WHEREAS, the Town desires to designate the Municipal Development and Tax Increment Financing District and adopt a Development Program for such District; and

WHEREAS, it is expected that approval will be sought and obtained from the State of Maine, Department of Economic and Community Development, approving the designation of the District and the adoption of the Development Program for the District;

NOW, THEREFORE, BE IT HEREBY VOTED BY THE TOWN:

Section 1. The Town hereby finds and determines that:

At least twenty-five percent (25%), by area, of the real property within the District, as hereinafter designated, is suitable for commercial and/or industrial sites as defined in 30-A, M.R.S.A., Subsection 5253; and

The total area of the District does not exceed two percent (2%) of the total acreage of the Town and the total area of all development districts within the Town (including the District) does not exceed five percent (5%) of the total acreage of the Town; and the aggregate value of equalized, taxable property of the District does not exceed five percent (5%) of the total value of the equalized property within the Town as of April 1, 1997; and

The aggregate value of indebtedness financed by the proceeds from tax increment financing districts within Cumberland County, including the proposed District, does not exceed $50 million; and

The Town expects that the Development Program will be completed within (10) years of the designation of the District by the Department of Economic and Community Development; and

The designation of the District and pursuit of the Development Program will generate substantial economic benefits for the Town and its residents, including employment opportunities, broadened and improved tax base and economic stimulus and therefore, constitutes a good and valid public purpose.

Section 2. Pursuant to Chapter 207 of Title 30-A of the Maine Revised Statutes, as amended, the Town hereby designates the Municipal Development and Tax Increment Financing District and adopts the Development Program, designated and described as more particularly set forth in the "Municipal Development Tax Increment Financing District and Development Program": in the form attached hereto and such Development Program is hereby incorporated by reference into this vote as the Development Program for the District.

Section 3. The Town Manager be, and hereby is, authorized, empowered and directed to submit the proposed designation of the District and the proposed Development Program for the District to the State of Maine, Department of Economic and Community Development for review and approval pursuant to the requirements of 30-A M.R.S.A.; Subsection 5253(1)(F).

Section 4. The foregoing designation of the District and the adoption of the Development Program for the District shall automatically become final and shall take full force and effect upon approval by Town Meeting and upon receipt by the Town of approval of the designation of the District and adoption of the Development Program by the Department of Economic and Community Development, without requirement of further action by the Town or any other party.

Section 5. The Town Manager be, and hereby is, authorized and empowered, at his discretion, from time to time, to make such technical revisions to the Development Program for the District as the Department of Economic and Community Development deems reasonable necessary or convenient in order to facilitate the process for review and approval of the district by the Department of Economic and Community Development, as long as such revisions are not inconsistent with these resolutions or the basic structure and intent of the Development Program.

Section 6. Pursuant to 30 M.R.S.A.; Section 5254, the percentage of captured, assessed value to be retained in accordance with the Development Program is hereby established as set forth in the Development Program.

Article 22: To see what sum the Town will vote to appropriate from the tax increment of the Pipeline / RT 302 Tax Increment Financing District for FY99/00 projects proposed in the Tax Increment Financing District Development Program.

Amount requested: $80,300

Selectmen and Budget Committee recommend the amount requested.

Article 23: To see if the Town will vote to appropriate $225,000 from undesignated surplus funds to a designated account that will be used for future Jordan Small School renovations, such project approved by a referendum vote on November 4, 1997 with construction scheduled to begin in or around the year 2001.

Note: An appropriation request of $225,000 was approved at the 1998 Town Meeting and it is anticipated that the Town will need to raise or appropriate a similar amount of funds in the next two fiscal years. All money appropriated will be set aside for the future project. It is also anticipated that by transferring the amount recommended or a similar amount over the next four years, there will not be a need to borrow funding for the project.

Board of Selectmen recommend transferring $225,000 and adoption of this article.

Budget Committee recommends transferring no funds and defeat of this article.

The School Committee recommends transferring $225,000 and adoption of this article.

Article 24: To see what sum the Town will vote to raise and appropriate for future construction of the Jordan Small School renovation project, such project approved by a referendum vote on November 4, 1997 with construction scheduled to begin in or around the year 2001 and such funds to be reserved in a separate account.

Note: The same appropriation request was approved at the 1998 Town Meeting and it is anticipated that a similar appropriation request will be made in the next two fiscal years. All money appropriated will be set aside for the future project. It is also anticipated that by appropriating the amount recommended or a similar amount over the next four years, there will not be a need to borrow funding for the project.

Board of Selectmen recommend no appropriation.

Budget Committee recommends appropriating $225,000.

The School Committee recommends no appropriation.

Article 25: To see if the Town will vote to appropriate an amount not to exceed $18,300 from undesignated surplus funds to pay the remaining balance due for the purchase of a brush chipper.

Article 26: To see what sum the Town will vote to raise and appropriate for the purchase of a generator to be located at the Jordan Small School. Such generator will be used for providing power to support an emergency shelter at the school and to provide limited power backup for the facility.
